Harvey Weinstein‘s rape retrial in New York concluded with a mistrial after the jury deadlocked, marking the third time a jury has failed to reach a verdict on the specific charge involving Jessica Mann.
The predominantly male Manhattan jury was tasked with deciding if Weinstein raped hairstylist and actor Jessica Mann in 2013, with Weinstein’s legal team asserting the encounter was consensual.
After three days of deliberations, jurors informed Judge Curtis Farber they could not achieve a unanimous verdict, though they were initially instructed to continue deliberating.
This retrial stemmed from an appeals court overturning Weinstein’s 2020 New York conviction and a prior mistrial last year where deliberations concerning Mann’s allegations broke down.
Jessica Mann testified that while she had some consensual sexual interludes with Weinstein, he subjected her to unwanted sex on the day in question, a claim countered by the defense highlighting her subsequent continued contact and expressions of warmth toward him.
