Beach house featured in cult classic ‘buried alive’ by sand

- OPRD denied her 2023 application for an Ocean Shore Alteration Permit, arguing she hadn’t proven sand accumulation affected the seawall’s function or built up against the house’s exterior.
- Niedermeyer has spent over $400,000 in legal fees appealing the decision and fears winter storms will damage her home without the seawall’s protection.
- OPRD maintains that a permit waiver process exists for moving sand accumulated against a residence but stated Niedermeyer’s denied application was for “more extensive work.”
